If a bank debt is sold to a collection agency, can the bank request that I still pay them?

Posted on: 03rd Nov, 2009 11:06 am
I closed my bank account and credit card with BofA. I still owed them some money on my credit card. I paid them some money toward the debt but did not finish paying it off. I was contacted by a credit agency that made a settlement that I could pay $300 off the debt. Now BofA has biled a garnishment. Can BofA still collect on the debt even though I paid the collection agency?
Hi perish!

Welcome to forums!

If the lender had sent the loans to collections and the collection agency collected the dues from you then you won't be liable for further payments to the lender. But, you've mentioned that you were contacted by a credit agency for settlement. If that's the case, then you should contact the credit agency and check out if they have made the payments on your behalf to the lender and settled the debts. If they have not settled the debts, then you would be responsible for the payments.

Feel free to ask if you've further queries.

Hi perish

On behalf of loan you must cleared to the collection agency after selling bank loan to collection agency and so the liability for paying loan comes to agency. In this case bank may be collect their outstanding by any sours. Given by you untill off.

In this case finding unco-operation by agency Off there dealing as usual as compromising only the debt would finish and finish the debt with bank and continue as you like as.
