i was divorced 3 years ago,and signed a quit claim deed. my name was never removed from the mortgage as agreed in the divorce settelment. now it has lapsed into forclosure, she has moved out, and called the lender and told them to take the property. what can i do to reclaim the property? since i have been served with forclosure papers, and i am still on the mortgage, how tough and expensive can this be? i have no idea how to contact her, and she will likely be against helping at all,if not hinder my efforts.
Hi verbalwarfare1,
Welcome to mortgage fit,
If there is any written agreement (as mentioned in divorce docs) between you and your ex regarding removal of your name from the mortgage then surely you can fight a legal battle against your ex.........
But if everything is a verbal memorandum then hardly you can do about it...
If you have docs you can immediately sue her for the breach of contract...
Feel free to ask any further query if you have....
