Hi...... I defaulted on a HELOC loan and just received "Summary Judgment" papers from the collection agency. I retained an attorney to file bankruptcy on this and other debts, but have yet to do so because I won't be able pay off his fee for another month or so. I have no job at the moment due to various layoffs, but I do have a pension. Can the collection agency garnishee my pension? I have no other income. Also, can the collection agency "freeze" my checking account? My pension check is directly deposited.

A collection agency will not be able to garnish your pension, your social security income. However, if you have a checking account, then the collection agency can garnish that account. But again, in order to do so, they will have to file a lawsuit against you and get a judgment in this regard.
