NAME ON DEED, NOT MORTGAGE

Posted on: 09th May, 2010 04:24 pm
MY HUSBAND AND I ARE BOTH ON THE DEED TO OUR HOUSE-HIS NAME ONLY IN ON THE MORTGAGE.
NOW DIVORCING, CAN I SIGN DEED TO HIM AND BE CLEAR?
CAN I BE HELD RESPONSIBLE FOR MORTGAGE?
IF I PURCHASE MY OWN HOME AND HE FORECLOSES, CAN THEY COME AFTER ME?
Welcome cmas,

As your name is not mentioned on the mortgage doc, you are not responsible for the loan. You can sign a quit claim deed and transfer the property to your husband. If the lender forecloses the property, he won't be able to come after you for the dues as your name is not mentioned on the mortgage doc.
