my home has been sold as of 3/10/09 the problem is that i was not aware of this sale date ...please note that 12/3/08 my lender had set sale date but i had provided info for a modification ..i did not hear back until mid feb. ..i had rec.a modification packet req to contact them by 3/13/09..i was not able to get thru to rep until 3/16/09 as would ring thru to voice mail & that was always full...to make a long story short i was advised that my home had been sold 3/10/09 ...i was not going to be able to agree to the modification but i was interested in poss. short sale as relatives were interested in purchasing home ....is it legal for the lender to not notify me of the 2nd sale date ??

The lender cannot sell off the property without informing you. Moreover, your lender had asked you to contact him within 3/13/09 in order to get a loan modification. It is quite surprising to me that he sold off the property on 3/10/09. In the meanwhile did you transfer the property to the lender?
