If I quit paying loan, can they lien the house I lien in? Can they lien the house my ex lives in if his name is not on the mortgage but it is on the house and my name is not recorded on the house. My name is also not recorded on the title insurance. I was the only one at the closing, my ex husband was not even there. My signature on everything. I live in PA. Can my ex continue to live there even if I do not pay the mortgage? What would you do?
If you are not paying the mortgage, the lender will start foreclosure proceedings and eventually foreclose.
Your ex can live there until the lender gives notice that he can not live there anymore.

If you quit paying off the loan, the lender can do 2 things - he can either file a lawsuit against you and place a lien on your property or he can start the foreclosure proceedings as John has said. If your ex-partner's name is not mentioned on the mortgage docs, then the lender won't go after his property if your property is foreclosed by him. Until the property is foreclosed, your ex-partner will be able to live in the property.
