Interspousal Grant Deed

My husband does not reside within the residence. Both my husband and I are going thru some rough times right now and he wants my name off the deed. If I transfered the deed solely over to my husband, can my kids and I stay within the home, even when my husband is not residing within the home til I find a place for my kids and I?

If you transfer the property to your husband, then he will become the sole owner of the property. In such a situation, you won't have the rights to stay in the property. Your husband will become the sole owner of the property and he may ask you to leave the property.

I see... if he says ok to having the kids and I stay there...would it be such a problem with the lenders knowing that we stay there while he's not there?

Hi t0mmygyr,

If your husband is ready to let you stay in the property along with the children, then I don't think the lender will have any issues with it.
