my ex has not been reasonable and im the innocent party,we have a mortgage together, ive tried taking her off the mortgage,to no avail, tried selling, and she wont sign the estate agents documents, saying she needs to know how much she is getting, she cleared the house out taking my things with her,i have nothing,i cant afford the legal route at the moment, what do i do? not pay the mortgage, and get repossessed, seems the only optionat present
Hi jbrint!
Welcome to forums!
If you can afford paying the mortgage dues, then its better to keep paying the mortgage. If you don't, your credit will be affected. You can try filing a partition lawsuit. In the partition lawsuit, the court will sell off the property. With the sale of the property, the mortgage will become due. So the mortgage will be paid off first and then the remaining amount, if any, will be divided amongst both of you.
Feel free to ask if you have further queries.

im nealy in thesame boat..... can i put the mortage just in my name??? from a joint one??
Does your partner have credit cards etc., you should make her aware of the credit loss of her's also. At this moment, paying the debts is a good option. After the mortgage is free, there are legal solutions to this these property transfers.
I bought a home with my now ex girlfriend. We both agreed she would keep the home, so I moved out months ago, she since then has stopped paying the mortgage and my credit is now going to hell. How do I get my name off the loan if possible and is it best we do a short sell at this point?
Thanks in advance...
Thanks in advance...
hi mack,
a short sale could be an option. but it is not the best option for you as your credit will still be affected by the short sale. the best thing for you is to get your ex to refinance the property in her name. this will remove your name from loan. you can also ask your ex to sign over the title to you and then, you can refinance in your name.
