Noone has given advice on what to do when the bank will not respond to you,or return calls etc?. . I have paid one attorney to fight foreclosure for over one year. The bank finally wins a judgement against me and at the last minute sends me loan mod papers. My attorneys says if they had refused they probably would not have gotten the judgement. When I call abt the loan mod I get thrown into voicemail day after day and the place closes at 4:30. Meanwhile, I'm horrified that my house will go up for sale. This whole process is horrible for the home owner. No one is accountable. By the way, the same rep that foreclosed on my house is the one that is handling the loan mod! What a travesty!

I think the bank is not willing to do the loan modification, which is why they are not responding to your calls. It may be possible that the lender have reviewed your financial statements, w-2 forms for the last 2 years, bank statements etc and they have found you ineligible for the loan modification. Thus, it will not be very fruitful for you to try and find out the status of your modification request. Instead, try to know whether they are trying to initiate foreclosure proceedings on the property. You can also check out the possibility of a short sale or a deed in lieu with your lender.
You have mentioned they have already got a judgment against you. Can you tell what type of judgment is it? Is it something for the deficiency that may arise from the foreclosure?
If the judgment relates to the deficiency, you will have to pay it. In that case, what you can do is, you can negotiate with the lender and set up a repayment plan that will help you in paying off the difference over a certain span of time.
