judgement lien on house

Posted on: 04th Oct, 2010 09:42 am
I have a credit card debt that was turned over to attorney/collection agency. They are willing to accept payments of $ 100.00 per month for 3 years. In return for that payment plan, I have to sign a " Consent to Judegement". I realize what that means, I am saving them the time of going to court and getting a judgement against me. This way, they already have a judgement in place .
The consent to judgement (that I am to sign) reads (in part) that they are granted a judgement at $ 3000.00 ( plus fee's etc.) . It also states that "no execution will issue, other than the filing of a judgement lien, as long as I make the agreed upon payments every month".....
But they told me verbally, that in order for them to accept the paymt plan, I have to sign the Consent to Judgement, and that they will file a lien on my house NOW, that way if I don't make the pymts every month, they already have the Judgement AND THE LIEN in place, and they can act on it immediately. Will my mortgage co be notified now of this lien?
Will my mortgage company find out that their is a lien on my house? don't like
Hi cindo!

Welcome to forums!

A lien can be placed on the property if the creditor gets a judgment against you. The mortgage company will not come to know about it automatically. However, if the lender searches the records, then he will come to know about the lien.

Feel free to ask if you've further queries.
