Late payments

I am running late on mortgage payments. Is is legal for the company to take my checks for past due payment?
They are taking payment on past due + partial payment on current bill.
The checks are cashed but not credited to my account.

I'm self employed and having a tough time paying on time each month.
Would like to know what my rights are here.
Deb you need to be in contact with your servicer in order to determine precisely how your checks are being credited to your account. Of course, they'll meet the previously owed portion of your debt first before applying funds to the most recent due date. That's perfectly normal. But if you're confused, the only way to allay that confusion is to be in direct contact with them and ask them specifically for that information.
