My husband is being sued by a credit card company and his court date is next week. We were both sick and he got behind on the payments. They have escalated to over $5,000 in fees and interest on a $500 limit account. The deed to our home is in both our names although the mortgage is in my name. Can the credit card company attach a lien to our home? Should he quitclaim it to me before the court date?
Hi tv!
Welcome to forums!
As your husband's name is on the property deed, the credit card company will be able to attach a lien to it if they get a judgment against your husband. If he transfers the property to you now, it might be considered as illegal. Thus, I would suggest you to get in touch with an attorney and take his opinion in this matter.
Feel free to ask if you've further queries.
