Would it be better to seek a Real Estate Lawyer and get help filing for a Deed in Lieu Foreclosure with the Mortgage company? Has any one had any experience with Chase on this issue?

You can yourself negotiate with your lender and apply for a deed in lieu of foreclosure. You'll have to write a hardship letter for the same. It is not mandatory for you to take the help of a real estate lawyer for it.

Thank you for the website to look at and get ideas from. Would you advise calling the mortgage company or just sending them the letter that I work up? When you call this mortgage company, you are transferred so many times to different departments that you make a circle to each department about 3 times till you finally stop it and say don't transfer me again, I have already been there. How do you go about doing this?

You should send your lender the hardship letter as James has suggested in his post. The lender will judge your financial situation based on that letter and let you know whether or not he would accept your request for deed in lieu.

Why wouldn't a bank accept a deed in lieu? If they are going to get the house back one way or the other. I would think that they would be smart to do a deed in lieu.
Question? My house is in my name not husbands, we have 2 cars and one has my name on the title too, the other only has his on the title, but the loans are in both names, if I filed a 7 or 13 on the house and did the exclusions on the cars, would we lose one of the cars? also I was told by a bankruptcy lawyer that my husband and I make to much money for the amount of debt and a 13 would be the only thing I could get, well that was before my husband got a house of his own and moved into it. Would I be able to file a 7, my house payment a month is just more than a net take home paycheck? I just really need advise on this issue. I only want to get out of my house, the balloon payment is due in early 2015 and I'm sure I will lose it then anyway.
