What are my rights as a co-borrower?

I cosigned a mortgage with someone 2 and a half years ago. I took legal action against him a year ago and have been trying to negotiate options with him for a little over two years. I was just notified that he is not willing to work with any of the options (sale, transfer title and deed and mortgage responsibilty to me or he refinancing). He has started filing a bankruptcy claim. How will this affect me? My credit? My ownership of other items? My husband?

Thanks.
hi desspaid,

as you are jointly responsible for the mortgage, his filing bankruptcy can effect you. but your ownership of other items or your husband will not be effected due to this. i don't think your credit will get affected.

however, to be on the safer side, it would be better if you could consult a bankruptcy attorney and take his opinion.

thanks
