SF Bay Area-> looking for a lender w/ current HOA litigation

Posted on: 26th Mar, 2009 12:27 am
hi

the homeowners association for the townhouse i live in is currently suing the home builders over some structural damage (mainly because the statute of limitation on the 10 year warranty is about to expire). this ongoing litigation has no set resolution time yet. needless to say, this is making my attempts to refinance extremely difficult.

i have contacted several credit unions, as well as all of the major banks. all of them have said that they would not be able to cover this loan. i have tried looking for mortgage brokers who will lend to places under litigation, but have had no success. does anyone know of any mortgage brokers who will lend to a complex while the hoa has ongoing litigation?

thanks

joe
Hi jdevil,

It is true that lenders do not offer loan for houses under litigation. However, you can discuss this with the community lenders who participate in this forum. They will be in a better position to help you in this regard.

Thanks,

Jerry
