I went to sign on my home that is being sold as a short sale and come to find out my sister has a judgement against her for a credit card debt which thought in NC they could not put a lien against your home. Now I can not close on the home therefore may go into Foreclosure or bankruptcy if can't figure a way to resolve. My sister filed bankruptcy in 2004 and I purchased the home in 2006 and because her name was on the deed they put the lien against the home. We have no money and the home is mine, I pay everything, her name was put on due to an injury I had where I lost income so they had to include her income. Can you tell me the best option to go. Since the lien has already been placed on the property, there's no use in getting a quitclaim or a warranty deed signed by your sister now. That will take her name off the deed, but will not take the lien off the property. I think the best way to resolve this issue would be to contact the credit card company, negotiate with them for a settlement of the debt and request them to remove the lien from the property. If you have no resources to pay off the debt immediately, you can ask them to set up a repayment plan so you can gradually pay it off.
