LIEN A PROPERTY OUT OF THE STATE I LIVE IN

Posted on: 23rd Oct, 2012 10:47 am
i live in illinois my daughter lives in oaklahoma. she barrowed over $3500 from me and gave me a promissary note and 6 checks stating i could cash one per month. then when the first check was to be cashed she closed her account. she refuses to repay the loan stating she has no money. i have sent her several certified letters and now want to lien her property. can i lien it from illinois and if not can i hold her responsible for my travel expenses if i have to go to oaklahoma to court?
Hi kac!

Welcome to forums!

You will have to contact a local attorney and take his opinion in this regard. As far as I know, you may have to file a lawsuit for filing a lien in that state where the property is located.

Feel free to ask if you've further queries.

Hi kac,

I agree with what Sussane has said. As the property is located in Oklahoma, you will have to file a lawsuit for placing a lien at the Oklahoma court. Your attorney will let you know whether or not you will be able to hold her responsible for your travel expenses.

Thanks
