Lien on neighbor

Posted on: 20th Jun, 2013 12:45 am
My neighbor's garage is 3 feet into our property. They are now losing their property and I, now, want to place a lien on the property so that I can recover my land and let the new owners know about this error. How do I place a lien on the property?
Hi Brandyy,

I don't think placing a lien will be the right option here. You will have to find out a legal proof that the garage is located on your property. You can contact a survey company for the same. You can even gather public records from the county recorder's office and contact the neighbor with the same and ask him to remove it from your property.

Thanks,

Jerry

Welcome Brandyy,

I agree with what Jerry has said. You should follow what he has said. Lien can be placed only when your neighbour owed you money.

Contact a lawyer. What you have is known as an "encroachment". Your lawyer can file a lien on the property, called a "lis pendens".
