My Question is, "Can a Debtor place a lien on a Home I don't own?". The Home is in my wifes name and has been for 33 years. I have Never made a payment to this home. I filed Bankruptcy back in 2004 and the Bankruptcy Judge allowed me NOT to list the home as part of my assets because of this. The Home IS NOT MINE...Please Help...Phrank

Creditor can not put a lien on the property of the person other than debtor in order to recover the dues.It is not at all legal.one preposition could be such that, if you are guarantor for the mortgage loan on the property owned by your wife then surely lender can put a lien on your property as well.
But if you are no way related to the property in legal ways,just mere a marriage connection won't prove you to be liable for the payment of bills.

Thank You dipaliqopale...I feel better..I'm sure my Wife will to...I'm not sure what a "Gaurantor" is , but I do know, I have never signed anything that had to do with this home. It was just never any of my business. The Home was inherited by my wife when her Father died and He left it to her ONLY. Not me, so I always respected his wishes...Thank You again...Phrank
