How do liens affect a refi+cash out?

Just found your website and I have a question.
My home is in my name and my ex-spouse's. He was hit with a judgement 10 years ago that has not been settled. I was awarded the house in our divorce, but his name is still on the deed.
1.) Can he quit claim to get off the deed?
2.) If not, what are my options?
3.) Does it matter if I attempt a refi+cash out?
I owe $38,000 on a $90,000 tax appraised property.
A6 allows up to 80% of the value in a new loan, yes?
I just need someone who knows the Texas RE laws to give me a hand.

welcome to forums!

your spouse can sign a quit claim deed and transfer the property in your name. this will make you the owner of the property. you can refinance the mortgage in order to transfer it in your name. however, if there is a lien on your property, then the mortgage lender will want you to pay off the lien before refinancing it. as far as i know, texas a6 laws will allow you 80% of the value of the home.
