The mortgage company listed me as borrower when I am not on the note

Posted on: 06th Dec, 2010 11:17 am
My brother purchased property a couple years ago. He is the solely borrower and the only one on the mortgage note. However, when I went to the closing escrow, the mortgage company prepared the documents and listed me as also a borrower on the deed of trust. It is illegal for them to do so. My brother is the only one on the note.
Why do mortgage company listed me as a borrower on the deed of trust when the fact I have never sign any note with them? I am so concern.
I'm guessing that if he was to defualt they could come after you. You in turn would have to spend funds defending what was done wrong in the first place. I would dispute this right away.
