names on mortgage & deed

My husband & I purchased a home in 2006 with both names on the deed and both names on the mortgage. It was a payday loan. My husband refinanced the home in 2009 and put the mortgage in my name only, but his name is still on the deed. He also had the house appraised for about 100,000 more than the real value. He is an unlicensed mortgage broker & did all the paper work and signed my name. We are now divorcing and he wants half the house and I have a 3/1 ARM that keeps increasing that he says he isn't responsible for. My family thinks he committed fraud. Any ideas?

As your husband's name is not on the mortgage, he is not responsible for the mortgage payments. As his name in on the property deed, he will be able to claim half of the property from you. However, he cannot sign your name on the documents. I would suggest you to contact an attorney and take his suggestions in this regard. He'll be able to let you know whether or not he has committed a fraud.
