name not on mortgage

after we were married my ex husband put my name on the deed of the house he purchased prior to the marriage. I
was never on the mortgage. He has now defaulted on the
mortgage and i am told my credit will be affected by this
even if i am not on the mortgage. can i get my name off
the deed in order to avoid any negative affect to my credit
score?
if you wish to keep home help him to keep paying off the mortgage or if you able to pay mortgage due then you can refinance this mortgage on yourself & if you wish to name off the deed then contact your attorney & just sign a quite claim deed.

you cannot change the ownership of the home at this stage and avoid the mess of a default. lenders would consider any change now as fraudulent and ask the court to vacate any such changes you made.

Hi BYCsportsmom,

Your name is not on the mortgage deed. In that case, though your ex-husband has defaulted the loan, your credit will not get affected. Moreover, the lender will not be able to sue you for the loan. As George has said, you won't be able to transfer the property to him now. It may be considered as a fraudulent transfer by the creditor.

what takes place as far as credit is concerned is that credit repositories pick up on public records. since any foreclosure action would need to be taken against both of you, your name woudl appear. the simple appearance of your name will cause them to report the mortgage as being in default under both of your names. as a result of your being named as a defendant in a foreclosure, your credit report will be affected.
