I tried to get a loan modification by myself with no luck. In fact my lender is just giivng me the run around and I am tired of it.

I have been searching all day for solutions to my problem and have decided that maybe somebody who knows how to deal with my situation professionally may be the right answer. The people I am dealing with at my mortgage company are ruthless...and I am nice. I just can't continue to pay my lender $30,000 a year in interest alone to stay in my home. I need someone who can talk with them for me on their level.

So I have found several loan modification lawyers on-line. The question is which ones can I trust not to take further advantage of my desperate situation?

Most of them want money up front and say if they can't do it they refund you a portion of your money. I'm looking at the ones who have a 95% success rate.

Has anyone here had luck with a loan modification lawyer?
I don't know if this help, but when I first went into foreclosure, I went to a free foreclosure counselor. They finally put me into a mod, but now I am back in limbo because they kept sending mod after mod, and each time the loan was increase. I didn't want to keep increasing the loan amount so I didn't send in the last mod. Now I am back to foreclosure status even though I was suppose to still be qualify under the old mod.

i was wondering, how would i know how to find out about my 2nd mortgage? i got my first and second thru the same company, but i was having trouble paying on time. the company gave my second mortgage back to the insurance company that insured my 2nd mortgage. they sent me a letter explaining that i should send my monthly payment to them. they never said the amount, so because it was an arm, i didn't know what to pay. i called them to send some kind of bill so i would know what to pay. haven't receive any communication with the company for a year now. what should i do next so i do keep owing more?

It is strange that the second lender or the insurance company did not contact you for the last 1 year for the payments. If you want to save the property, then I think you should contact your second mortgage lender and check who your insurance company is. You can then contact the insurance company and pay off the dues.

I tried to work with my lender on getting my loan modified. They kept stringing me along with repayment plans first for 6 month and said that at the 6 payment I need to request it and they would place me on a new repayment plan for 3 month while the reviewed my situation. The repayment plans where efirst they put me on the repayment plan that was for three month

For months my bank strung me along with payment plans. The last one I as given they said when I made the last payment I should call and they would send the paper work, well I missed missed one of the payment so I didnt fill out the paper work, i figured I would start over. They insisted I complete the forms so i did. and a month later they declined my loan mod request because of the missed payment. So now I hve no other option but to make the loan current. Now I'm 60k past due 17 payments because repayment plans payments didn't cover the entire mortgage. According to them I have to wait one year before I will be concidered again. I don't know if i need an lawyer to file a chapter 13 or one to work something out with my bank. Question ? when do you start to file? Do you need to receive forclosure notification?

Hi Anita!

Welcome to forums!

I would suggest you to contact your lender and negotiate for a loan modification again. Check out if they are ready to help you in this regard. If not, then you can file Chapter 13. It's not mandatory that you need to receive foreclosure papers to file bankruptcy. You can file it now. However, I would suggest you to contact a bankruptcy attorney and take his opinion.

sussane, anita just noted in her post that she had to wait to reapply for a modification.

anita, your post will help others, i hope. you noted that you missed a payment during your modification period - this cost you. it's clear that once a borrower enters into a modification agreement or any other such arrangement to clear up a delinquency, that payments must continue or the lender will lose faith in the agreement.

i hope others will take heed of this predicament that you've encountered. i also hope that you'll be able to get everything worked out to your best advantage.

In California a Loan Modification Attorney can not accept funds up front, they can only charge as work is completed. It is the new SB94 bill passed in Oct 2009.

christine, i like the suggestion you made about checking with the bar association. often, i think, they'll know more - much more - about the bad guys than the bbb would; and sooner, too, i'm sure.

of course, the modification business is not just lawyer-driven, either. there are plenty of scam artists who lack law degrees, but who talk such a good game that they hornswoggle droves of troubled homeowners.

i think it may well be worthwhile to check with one's state's attorney general's officer (lots of apostrophes there, eh?) for companies that are also being investigated or that may have been charged with fraudulent practices.

there are probably other worthwhile state and federal agencies that should be included in the list of "who to contact to check on..." if anyone else has suggestions, how about chiming in?

In this market there are laws that no up front money is allowed. They can charge only when they perform their services and thats what our legitimate Attorneys do.
