Hello there, we are total now 13 months behind, fell 1 month & Saxxon will not allow catch ups unless in full. Then worked with them 5 months for modification & no luck,. Found Home preservation specialist & been working with them 6 months & they told us not to go to no Court hearings because it would be a waste, & they kept guaranteeing our home to be saved, well today we get a letter that it is being sodl on the 18 th that is 17 days. We have a mother on 24 oxygen & a 3 month old baby, i have been asking them if we should just sell or move or waht? No your fine, can we sue them? I have every email..

I can understand your situation. You are going through a tough time. However do not lose hope.
As far as your question is concerned, I would suggest you to first have a talk with the home preservation specialist. See what they are saying. If you are not satisfied then you can take legal help and sue them in the court.

You mean they have send you a notice regarding the sale of the property? this looks like they have intended to foreclose without keeping you informed about it. Well, you can sue them but then in your situation, you shouldn't use your hard earned money on attorney fees and court charges. Moreover, they're a company after all and it's quite tough to fight out a case against such companies. So, I suggest that you request them for a deed-in-lieu. Well, it's tough to accept but the fact remains that you will not be able to keep the home if you go for deed in lieu.
