Lose property in bankruptcy

Hello everyone… I'm planning to file bankruptcy and have found in Florida, 1/2 acre of property is exempted and in case of married couple, 1 acre is exempted within the city limits. We own 1.7 acres that can't be divided so what will happen now? If we file, will we lose the property?
Hi Salmon,

You will have to include all your assets in your bankruptcy filing. As far as I know, the bankruptcy trustee will sell off the property and give you the amount equivalent to your exempt property. The rest of the amount will go toward your other debts. However, bankruptcy laws are complex and you should have a word with your bankruptcy attorney in this regard.

In general, the trustee represents the interests of the unsecured creditors, or general creditors. If, however, there are no assets, the debt is discharged, and the creditors receive nothing.

Hi Salmon!

Welcome to forums!

If you file bankruptcy, you will have to list all your assets including this land in it. Now it will be the trustee's discretion whether or not he will sell off your property in order to repay your creditors. However, most likely the trustee will sell off the property in order to pay off your creditors/lenders.
