we had a first and a second. the second was written off in a chapter 7 bankruptcy. the first was also written off even though we re-affirmed it through our attorney. now we have been going through the loan mod process for a year with emc mortgage. i went to the consumer affairs website and read some of the stories from just emc customers and it looks very grim. they lose paperwork, they say they do not have it when they do , they send letters that make no sense and every single time we call we get a different story. what on earth is the deal with this? will they or wont they, i want them to just let us know!

It will be the lender's discretion whether o not the lender will consider your request for a loan modification. You should contact the lender immediately and ask them to let you know whether or not they would accept your request for a loan modification. You should keep in touch with them on a regular basis in order to know whether or not they would accept your request.
