I am going through a divorce. My soon to be ex lived in our home but never made mortgage payment. He was court ordered to sell but was found in contempt for not cooperating with selling of home. He was court ordered out of the home and I gained possession. I was approved for loan modification to bring mortgage to date but he refuses to sign. I want to bring mortgage to date and sell the home. I do not want it. I do not want it to be foreclosed and destroy my credit. Can a court order him to sign the paper? I no the house will not sell for what is owed.
As far as I can understand, you can definitely go to the court in order to make your ex sign the property deed. This will help you in bringing the loan current and also help you in selling it off.
