loan modification during divorce

Posted on: 30th Sep, 2010 10:35 pm
My husband did a loan modification on our mortgage without telling me. I only found out by mistake after getting a letter from the mortgage company (since I am on the loan and the title). I called and had them fax the paperwork for the loan since I had not signed anything. To my surprise, he put "refused" in lieu of my signature along with a letter telling them that I had refused to sign and he was going through financial hardship due to our divorce. He also stated in this letter that I told him I wouldn't sign anything. Even more shocking to me is the fact that it was approved no questions asked. I had no idea this happened since I was never asked. Is this even legal? So what now, he can also remove me from the title claiming I am dead?
Hi zizzol,

If you and your husband are on the property deed, then your signatures will be required on the agreement in order to get a loan modification. I don't think it is legal for the mortgage company to modify the loan without your signature. As the property title is concerned, your husband will not be able to remove you from the deed unless you sign a quit claim deed in his favor.

Thanks.
