Mortgage Modification

My ex modified the mortgage note without my signature and they show her now as the borrower. Am I still liable for this note? Should the mortgage company remove my name at my request? I have never seen any paperwork on this modifiaction other than what I saw when I took her to court over her being late on payments prior to the modification. Your help would be greatly appreciated.

It may be the case of 'signature forgery'.You should contact the mortgage lender and ask them whether they have document evidence to prove that you are still on the mortgage.Make sure you get it in written format...

If they say (and put it in writing) they do not have any proof that you are on the mortgage then it is well and good ....no need to worry ....go ahead..

If they say they do have the proof then surely you can continue with the current case against your husband and add one more clause regarding the 'forged signature'.

If your name is not mentioned on the mortgage docs as one of the owners of the property, then you're not liable for the mortgage.

Many companies want to help you request a mortgage modification. The price to pay for their services is high - often as much as a monthly mortgage payment. You do not need anyone to help that you need to apply for a mortgage modification.With lower monthly payments, you could end up paying more interest over the years. If the loan modification that keeps them afloat, may be worth the cost.
