Hi there... My father passed away few weeks ago. He did not leave back a will. He has some credit card debts, a vehicle loan and a personal loan – all in his name. In such a situation, will my mother become liable for paying any of these?
hi guest,
if your mother's name is not mentioned on the debts as incurred by your father, then she won't be liable for the debts. however, if she wishes to save the vehicle, then she will have to refinance the loan in her name and pay off the loan in full.
thanks,
jerry

Hi Guest,
Your father's debts will be paid off from his estate. If he hasn't left a wil, then as far as I know, no one will be legally liable for the debt payments.
Thanks

Your mother will not be responsible for paying down the debts of your deceased father. The real estate (it includes car, home, cash etc), will be responsible for paying down the debts.
Are you in a community property state?
