Mortgage rights?

A girlfriend and i bought a house together back in 2008. in 2009 she kicked me out and for the past two years she has been living there making the payments. recently she contacted me requesting that i remove my name from the mortgage. initially i agreed but now believe i have certain rights. Do i have any rights? I recently recieved a quitclaim from her lawyer. What should i do?

if your name is mentioned in the property deed, then you will be considered as one of the owners of the property. in such a situation, you can claim a certain amount of money in order to transfer the ownership of the property. after you transfer the property, she can refinance the loan and remove your name from the mortgage docs.

Welcome to Mortgagefit,

Just being on the mortgage docs won't entitle you any right of ownership and thus you should make sure that your are on the deed as well in order to claim any monetary benefit.

But never sign on the quitclaim docs until she agrees to refinance the mortgage because later on you will be caught in the trap....So get it a written agreement that she will refinance the mortgage once you quitclaim the deed to her...
