Hello,
I am applying for a refinance; the loan officer said I could qualify for a lower point loan (over one point less) if she used just my information as I have a better credit rating than my spouse. I can qualify for the loan based soley on my income. My spouse is currently listed on the title and would continue to be. My spouse is understandably concerned that she wouldn't be an owner of the house, the mortgage payments would not show up on her credit report, and it would be a nightmare if I died. I would appreciate any knowledgable (quick!) help on these questions. Thank you very much!

There are chances that the lender may deny the modification of the loan if your name is not mentioned on the mortgage note.

My husband and I purchased a home before we were married. His credit was better than mine so the loan is in his name only. We have been splitting the ocst of the mortage since day one. Can we split the interest in the home on our taxes?

I filed for divorce. During this process I recovered documents locked in my husbands lock box, after cutting the lock. I am on the mortgage and deed of trust. I discovered and 2nd Mortgage loan on the home in the State we live in and a 1st mortgage loan on our home in another state. He says he will, however, put me on the title.
My question is:
The title conveys ownership of the property, but if we get separated or divorce before the mortgage is paid off, what will I actually own? Do I own half of the portion that's already been paid off? Or do I not actually own anything until he has paid off the mortgage in full?
And in general, besides the mortgage not being included in my credit history, are there any other downsides to not having my name on the mortgage?
And is there a way to add my name to the mortgage at a later date once I've lifted up my credit score more?

My ex husband's name is on the mortgage, my name is only on the title. He is responsible for making the payments and the house is for sale. My question is if there is a way I can take over the payments and keep the house.

You will have to refinance the mortgage in your name and pay off the mortgage dues on time in order to save the property. Also, you will be able to get a refinance only if there is 20% equity in your property.
