In our divorce decree it states that I shall assume said mortgage unitil is sold. In the same article it states that in the event the home is not sold or rented and remains vacant she is liable for half of all payments, insurance, etc.
I am in the military and moving next month. My ex is claiming that she has consulted with a lawyer and because it says assume said mortgage she is going to send me loan assumption paperwork?
Is she twisting what the decree says?
She tried to refi the house in her name but her debt to credit ratio was too high.
She has also threatened to file bankruptcy but there is a clause in the decree which makes the obligations listed in the decree non-dischargeable.
The bottom line is I feel that she is going to do everything to get out of her obligation and I'm unsure of how to proceed and feel like I will have to pay the whole mortgage by myself once I move.

You are responsible for the mortgage unless the property is sold off within a given period of time. If the property is not sold off, then your ex-wife is also equally liable for the mortgage payments. I will suggest you to contact an attorney and take his opinion in this matter before signing any assumption papers.
