my house was foreclosed Jan 2007 1st mortgage settled, 2nd mortgage was not, I was contacted 6 mos later by collection agency requesting $46k, I explained I would not be able to pay, I would have to consider bankruptcy. Never heard anything, I was contacted again in 2008 I repeated my my response, they advised hey would proceed with judgement hearing. I never heard from them again.
Today 10/15/10 I was contacted by DCS (Diversified Collection Services, Inc.) | A Performant Company | 333 North Canyons Parkway | Suite 100 | Livermore, CA 94551. I was advised that I now owe $68k, they will consider a foreclosure settlement of 10% ($6800) 10% is something I would consider if I could make monthly payments.They (DCS) want an answer by 10/19/10. Is this valid or a scam ? Would you be able to advise me on this matter?

You should ask the collection agency to validate the debt. If they can successfully validate the debt, then you should make the payment to them.
