can someone advise me???

I need advice on this.. my ex girlfriend and i bought a house together back in 2003. she left me in 2005 and we agreed that i would sign over everything to do with the house and she would give me some money to walk away. she moved out while she got the money together,and while she was gone she decided that she wanted to make a go of things and would come home as long as we still kept to our original agreement.

I agreed as i wanted her to come back home and we said that if things didnt work out again,then i would have my money and she would still have the house. She did move back in 2006 and in that time i signed the house and she gave me money. (not long after she asked me for lend of the money i got,which i foolishly did)However in 2009 we broke up again and i moved out as agreed and we both moved on with our lives. However,today i found out that she never completed her part of the paperwork when i signed and the mortgage is in arrears..

i havnt paid anything on mortgage since i moved out in jan 2009 because since 2006 i believed i had nothing to do with the house, although when we lived together i paid half everything.(she hid all letters coming to the house iv since learned) my solicitor told me that because i did sign back in 2006 i had signed the house over to her,but because she didnt complete her part,new paperwork has been sent to her solicitors for her to sign. she will not go to the solicitors despite him trying to contact her.

I have been told though that i am now liable and until she signs the new paperwork i have the right to go into the house if i choose to. i know from my old neighbours that i still see that the house has gone into disrepair since i moved out. I dont want anything to do with the house though because i had gotten used to the fact i didnt own a house since 2006.

i have spoken to the ex today but she just keeps making excuses that she dosnt have time to go see her solicitor and if i try and make her sell the house she will say to any court that i havnt bothered paying towards the mortgage..(even though i didnt know i still was on the mortgage) and i would end up paying thousands in costs etc. Also she still owes me the money and i wonder if because i found out i still own the house is this the reason she hasnt paid me back.

She must have known all along that i still owned the house,and obviously thought i would never find out. can anyone advise me or anyone been in a simular situation. thanks.

You have mentioned that you signed the property deed in your ex-partner's favor. This has made her the sole owner of the property. However, I guess she did not refinance the mortgage in her name. In that case, you are still responsible for the mortgage though you are not the owner of the property. If the mortgage dues are not paid on time, the lender can come after you for the mortgage dues to be paid in full. If the property goes into foreclosure, then it would affect your credit as well. You even cannot force your ex to sell the property as you're not the owner of the home. You'll have to negotiate with her in order to make her sell off the home and pay off the loan.

hi thanks.. the problem is i am still the owner after finding out off my solicitor because she did not complete her side of the paperwork which i was told yesterday expired 2months after i had signed. she never went into her solicitors at all. so anything i signed then became invalid. At the end of the day she conned me everyway possible and she thought i would never find out. that or she was just too lazy to go in,because i was told by my solicitor that her solicitor has been trying to contact her for some time now. All in all its in her best interests if she re signs because she dosnt want to sell or have me move back in.. (i actually have no interest anyway).i thought the house was all hers. i have moved on so i dont want to fight for something i didnt think was mine anymore. thanks.

welcome to forums!

if the quit claim deed was not filed and if you are still the owner of the property, then you can request your your ex to transfer the property to you. once she does so, you can contact your lender and refinance the loan. if she is delinquent on the mortgage payments, then you'll have to bring the loan current and then refinance the loan.
