Mortgage Responsibility

Deceased Husband buys house for second wife with Deed in her name. But the Mortgage is in his name which now belongs to the Estate, belonging to his children. Is the Estate responsible for paying off the Mortgage? Everything they receive is in a Trust, which is almost $1,000,000.00. They are not going to Probate because they don't think they are responsible for the mortgage there dad had. Can they take my house and will I have to pay for it, if the bank will even let me. This is all he left me and he said it was taken care of in the Will. That the estate will pay for the house. But they say they will not. What do I do?

As far as I know, it is your husband's estate which will pay for the mortgage as the home loan is in his name. I would suggest you to contact a real estate attorney and take his opinion in this regard. Also, if your husband has left a will, then it needs to be probated. It is only then that the property would be divided amongst the heirs as per the will.
