Was told lost mortgage payments do not have to be corrected

if your mortgage company has lost a payment and while trying to get it corrected they take another payment and apply it to late fees, making you 60 days late, and it has been over a year, and they still have not found the missing monies from the first payment, is it true that since it is over a year they can refuse to correct your account? Should I get a lawyer and if so will they even be able to have the errors corrected?

They should correct the account irrespective of whether 1 year has passed off in between. If they are not ready to rectify their fault, then you should contact a real estate attorney and take his opinion in this regard. He may negotiate with the lender in this regard.

I agree with Sussane. They cannot refuse to rectify the wronged item. As suggested, it will be better if you could take help of an attorney to negotiate in this regard.
