I am an investor and lost rentals, now one bank is coming after me, and the sheriff wont quit knocking at my door I signed it once, but he states I signed to late and they refiled. I read they only have 30 days after foreclosure to file? if true why and how can he keep knocking on my door for this? Also can I just tell him to leave and get off my property? He beats on it evry morning from 6:30 -7:15. I just hide I'm scared of being sued, but I have nothing in my name or own anything now.
If I file bankruptcy how long does my house and a lot my husband and I own have to be out of my name? I dont want them getting our home and lot, and other properties that we put in just his name about a year ago, we live in Georgia. Please answer I need help. The kids and I are tired of hiding in the closet and being late for school. Thank you.

The bank has the rights to come after you once the foreclosure sale is over, if he is unable to recover the whole mortgage payments. He has the rights to recover the balance mortgage payments. You can contact your lender and ask him to forgive the balance amount or request him to give you a payment plan so that you can pay off the balance amount in an affordable manner.
If you file bankruptcy, the lender will not be able to come after you due to the automatic stay. If you file bankruptcy alone, then your husband will not be affected due to that but you'll have to list all your properties in bankruptcy including your jointly owned properties.
