my girlfriend had gotten a settlement and the ex got the house. however, he never followed through with the quit claim deed and is now 3 months behind on the mortgage payments. what can be done?
If your girlfriend's name is on the mortgage deed, then she would be held responsible for the mortgage. The lender can sue her for the debts. Moreover, if the property is foreclosed upon, it would affect her credit. Your girlfriend can ask her ex to apply for a loan modification.
even if he followed through with the quit claim she'd be in the same trouble. taking her off title doesn't remove her obligation to the lender. she needs to get off the note and the only way to do that is with a refinance or sale of the house. her credit is now tarnished and she needs him to do one or the other as soon as possible.
if house was awarded to Ex, he should refinance mortgage in his name.
