now i need my name clear. she will not refinance the house.she doesnt have credit to do so. the divorce states she is responsible for payments and up keep. she is now 3 months late on the martgage payments. the bank is in pre-forecloser.
i am the only one on the mortgage, we are both on the deed. my credit report is being damaged. i want my name back. she has an annuity and will not try for a refi. i am at my wits end.

swmorison, divorce decrees issued a few years ago never took into consideration a drop in the housing/mortgage markets. your credit will, indeed, suffer as a result.
trying for a refinance is not exactly something simple for someone who is 3 months past-due and in pre-foreclosure. that's not to say it's impossible, but if she's like 98% of the population, she's probably frightened and unaware of what needs to be done. it would be a wise move on your part to assist her by guiding her to a loss mitigation specialist that can help her out. check out the hud website at hud.gov.
