Husband has secret debts--am I liable?

I just found out that my husband secretly opened 'several' credit accounts a couple years ago that he stopped paying on. I recently found a letter from a collections agency saying that he owed them about $4900.00. I don't even know for sure how much more debt or how many more creditors are out there. He only works part-time and doesn't bring home enough to have his wages garnished. I am worried that a lien could be put on our house, though. If his name is NOT on the mortgage, but IS on the title, can creditors put a lien on the house?? If yes, but they haven't done it yet, can I get him taken off the title?? (I'm in Virginia)

If the debts are solely in the name of your husband, then you're not liable for it. However, as your husband's name is on the property title, the creditors can place a lien on your property if they don't receive their payments. As the lien has not been placed on the property, you can ask him to sign a quit claim deed and transfer the property to you so that he doesn't remain the owner of the property any longer.

I second that. By all means, you don't need to worry about repaying debts that are not your own. However, they certainly have the right to place liens on any real estate your husband has an interest in. So, James' suggestion that he quit claim his interest to you isn't a bad one. Now you just have to get him to sign on that dotted line.
