My mom recently passed away. She left a home with a small mortgage to me.

She also left some large credit card bills and hospital bills. The property is homesteaded in her name but I will have to put it into my name shortly. Will the creditors have the ability to make me sell it to pay them off?

She left any Will before passing ?
Is you alone beneficiary of her property?

If you want to sell this to pay off to creditors then you must have to put your name on property deed that means you must have property ownership to sell it. Then you can sell this house & use money for pay off creditors.

Hi williamsjon,

For unsecured debts like credit card debts etc, the creditors cannot force you to sell off the home. They cannot sue you as well because you personally are not responsible for those debts. What the credits can do is, they can put a lien on the property. However, the mortgage lender can foreclose the house, if you stop paying the mortgage.
