I am going through a divorce and can not get my ex to settle. She has had many opportunities to settle and want more more more. I am tired of this and want to sell the home that we had together. Can I place it on the market and begin the process without her???? She is the co-owner
very simply...no. you'd have to take legal action in order to separate her from title, which isn't a fun process either.

I think you should file a partition lawsuit with the court. The court will sell the property to pay off the debts and then distribute the excess amount, if any, to both of you.

I also think filing a partition lawsuit is a good option. Since she is not willing to settle it out of the court, there is no way but an intervention of the court in this matter. This will help you sell off the property and get your share of interest in it.
