I have been separated from my spouse for about 7 years. I am not divorced because he has yet to sign the papers. I would like ro purchase a home but I don't want him to have anything to do with it. Is that possible or do I have to wait until sometime in this lifetime when he decides to sign divorce papers?
Hi DB,
Are you in a community property state? If you are, then I think you should wait until the divorce papers are signed. Otherwise, he may claim his interest in the property in future. You can still purchase the property. But in that case, you will have to get an interspousal deed signed by him wherein he would release his claim in the property.

Hi DB,
Ok I understand your problem.First you sign divorce paper then purchase property.Because Its risk to invest money in property, might be she claim in your property and legaly she has share with your property.
So better way divorced her then purchase property.
This is legal way but here might be another way to purchase property, so try to take advoice from any expert lawer.
I hope you understand what you need to do...!!!
Thanks
Hari

db, you ought to be discussing this with your legal counsel, don't you think?
