Am I liable for our mortgage?

Posted on: 09th May, 2009 02:01 pm
We our trying to sell short sale but I have a question. The mortgage company says that I am not on the mortgage and they will only speak to him. I thought that was right but when I looked at our mortgage paperwork I had to sign a bunch of stuff. The bill comes in his name and it is on his credit report only as Responsible party: Individual. Am I liable for the mortgage? and if so can they come after any of my assets?

Thank you
If it does nto show up on your report and the loan documents should clearly state who is responsible to pay the Mortgage.

I do nto think you are liable legally for payment and they cannot come after you.

Hi jzeidieh,

You will have to check your mortgage docs to find out if your name is on the mortgage or not. If your name is not on the mortgage, then the lender will not be able to come after you for the deficient amount. Moreover your credit will also not be affected due to this short sale.
