DIVORCE

My husband left the home 4 months ago. We just bought the house 1 1/2 years ago and the remaining balance is 349,000.00

I hired a short sale lawyer and for the past 4 months people have been coming to see the house but no bites as of yet.

The bank recently called me and left a message - I emailed them back in July but never heard anything from them.

Am I suppose to let them know why I have not been paying the mortgage? I am left with only 1 income now.

You can call the bank and explain your situation and ask for loan modificiation

it is imperative that you be in contact with your lender. if you have no contact, they're going to begin foreclosure proceedings against you. they will have to approve any short sale that you propose, so you need to apprise them of the fact that you're seeking a sale on that route.

here's the puzzler: you are working with a lawyer yet you haven't received legal advice that you ought to discuss your situation with the lender. i call that very strange, and it may be time to find a new lawyer - one who knows how to do what you propose to do.

George you have good point that the lawyer is yet to suggest this poster to call the bank

Probably a good idea to change this lawyer

A short sale isn't possible unless the bank agrees to it first ... the Attorney should know that. This doesn't make sense.
