my mortgage company states that they paid my space rent in 2002 for a total amt of 1803.00 my space rent is not that high. I believe that there has been some incorrect accounting and have asked for the proof of payment in the form of the front and back of the cancelled checks. 5 months later and they still have not produced them but state if I do not pay they will evict me due to non payment of these fees. Can they do this? They say my loan is delinquent however I have paid the monthly P&i and insurance and the statements show the postings and current monthly pmt due.

If you don't pay off the space rent, then the lender can evict you for the dues or place a lien on the property. You should once again ask them to provide you with the statements regarding the space rent and pay off the dues in full.
