I bought a house in January 2010, now the house foundation is cracking the walls show that the bank covered up the foundation cracks, and i even got sick from mold that they covered up that is now starting to show in my bedroom, can i sue someone?
Hi mj32johnson

Before suing to bank you need to check out your agreement with the purchaser (bank) and then only you can go ahead with this.
Rather a real estate attorney's advice could be more useful.

Sorry to hear about your situation, mold is serious issue. However how do you know it was the bank and not the previous owner?

Well put, Shane. Also, I think Dipa's suggestion that a consultation with legal counsel is in order, and looking over the original contract will, perhaps, shed some light on any potential liability of others.

In all probability, you only recourse would be against the previous owner/builder and/or the home inspector. However, if this was something that the previous owner(s) deliberately hid, you will have a hard time proving that the building inspector is responsible. Banks typically don't obscure defects, they just knock some more $$$ off the price.

If this was a short sale or foreclosure situation, I doubt you'll be able to get any money from the previous owners. If they had money, the house wouldn't be in that situation.

And if you're really serious about pursuing legal action, you need to talk to an experienced attorney who deals in real estate liability issues.
