MY life was almost perfect I had just had my 3rd child I was a month ahead on my morgage payments for a year and it was very convient program we had been in were we payed every 2 weeks my credit score was rising and my marriage was wonderful we were both empolyed until
the major flood in RI this past march
my home was distroyed.........
my wife called our lender while our home was under 20 feet of water to inquire about if we were to fall behind on our payments due to this disaster it took her a few calls till she remember the name of a supervior in the past we had delt with the sup told her she would put her in a speacial program for disaster victims my wife thanked her and she said the loan would be suspended for 90 days
thats when the disaster realy happened 90days went by and we started to get door knockers we were in per forcloser and we didnt know why when we call the demaned all 3 months and wouldnt except partial payments my wife had a neverous breakdown and had to be in the hospital i srapped up 2 months they accepted in july in aug the rejected when i inquired why they said because it was a partial payment my credit was distroyed and i had to fight with loss midigation for months they lost paper work it was a mnightmare inoct i found out the aug payment was rejected because it was payed thro a bill pay not because it wAS A PARTIAL PAYMENT THE LENDER NEVR sent me anything in writing explaing this forbearnce agreement had they done this i would have never aggreed we were not in dager of foorcloser and should have been told in writting how this would affect my loan they caused my life to go from a happy marriage to almost divored my childern are always seeing us fight do to the sever stress this has caused and my wife is now on ssi i want to sell my home and sue my lender for a breech in contract bad faith and mental angish i ahve had to care for my wife and children because they didnt follow thro with sendind out a forbearence agreement and i would have declined when i read the wolve in sheeps clothing the msajor problem i have is we were fine why would they do this to me and my wife isnt on loan supvever knew that they should havenot allowed her to do that
Welcome shutek,

Well, it will be difficult to tell why the mortgage supervisor allowed for a forbearance of 90 days.

If you do not intent to save the property, then you should contact your lender and apply for a deed in lieu of foreclosure. This will help you in selling off the property but it will have a negative affect on your credit report and you won't be able to get a mortgage for the next 3-4 years.

how will it be difficult seeing we were not in danger of loosing it prior the flood and why didnt any paper work get sent out explainling the forbeaence we never allowed it to go into forcloser yet had we had the forbearance explained we have ot agreed to it because we wre not in forcloser now but the trouble we went throu to get out of it was all do to there unethical behavior im not one to complain yet what they did was wrong and its a lender and im anobody so every thinks im lieing its making me angry they breech their contract im a big looser for not making my y paymenments i have a lender to rely on to prvide me details because this is not my profession and they failded to do so i thank u for ur feed back yet im not in forecloser im just working with sba they want to relocate me

Hi shutek,

You may contact an attorney and check out if you will be able to take any legal actions against the lender for not giving you the correct information.

Thanks
